These Terms & Conditions (the “Terms”) are an agreement between you, the business owner or business signing up (“you” or “Client”), and Leader Publishing Worldwide Inc. (“we,” “us” or “Launch Marketing Suite”).
By signing up for, paying for, or using Launch Marketing Suite (the “Service”), you agree to these Terms. If you’re signing up for a business, you confirm you have authority to agree to these Terms for that business.
The short version
- Launch Marketing Suite is $197 per month, billed automatically until you cancel.
- Your website, templates and marketing assets are licensed for use only inside your Launch Marketing Suite account. They can’t be sold, shared, or moved to another account or platform.
- Your own content and customer data stay yours.
- You’re responsible for using email, texting and reviews in a lawful way.
This summary is for convenience only. The full terms below are what apply.
1. The Service
1.1 Launch Marketing Suite is a marketing system for small businesses. It is delivered through a sub-account inside our agency account on the HighLevel platform (your “Account”). It includes an industry-specific website template, marketing assets and the tools described on our sales page, such as CRM, email and campaigns, social planning, SMS and social messaging, missed call text back, reputation management, ads management, calendars and appointments, sales pipeline, invoicing and estimates, loyalty programs, QR codes, a local marketing audit, and a client guide and opt-in funnel.
1.2 We may improve, change or replace features from time to time. If we remove a feature that is central to the Service, we’ll let you know in advance.
1.3 The marketing assets for your industry are templates. The same or similar designs are provided to other clients in your industry, and they are not exclusive to you.
2. Your account
2.1 You must be at least 18 and provide accurate business and billing information.
2.2 You’re responsible for keeping your logins secure and for everything that happens in your Account, including actions by team members you give access to.
3. Pricing & billing
3.1 Price. The Service costs $197 per month, plus any applicable taxes.
3.2 Automatic renewal. Your subscription is ongoing and renews automatically each month. By signing up, you authorize us to charge your payment method on file every month until you cancel.
3.3 Usage charges. Usage charges for text messages, phone calls, phone numbers, email sending and similar services are not included in the monthly price. They are billed separately based on your usage, at HighLevel’s standard rates.
3.4 Failed payments. If a payment fails, we’ll attempt to charge it again and may contact you. If payment isn’t received within 7 days, we may suspend your Account until it’s paid.
3.5 Price changes. We may change the price with at least 30 days’ notice. The new price applies from your next billing date after the notice period. If you don’t agree to the new price, you may cancel before it takes effect.
4. Cancellation & refunds
4.1 How to cancel. You can cancel at any time through your account dashboard. To avoid being charged for the next month, cancel before your next billing date.
4.2 When it takes effect. Cancellation takes effect at the end of your current paid month. You keep access until then.
4.3 Refunds. Payments are non-refundable, and we don’t provide refunds or credits for partial months or unused features. This does not limit any rights you have under applicable law.
4.4 What happens after you cancel. When your subscription ends, your access to the Account, your website and the licensed assets ends. Your website will be taken offline, and automations, campaigns and phone numbers will stop. See section 6 for exporting your own data.
5. Our assets & your license
5.1 What we own. We (and our licensors) own all websites, templates, funnels, designs, layouts, graphics, mockups, print designs, email and text templates, automations, workflows, guides, copy and other materials we provide as part of the Service (the “Assets”), including any customized versions of them.
5.2 Your license. While your subscription is active and paid, we grant you a limited, non-exclusive, non-transferable, revocable license to use and customize the Assets for your own business, only within your Launch Marketing Suite Account.
5.3 No resale or sharing. You may not sell, resell, license, sublicense, give away, share or otherwise distribute the Assets, or any part or copy of them, to anyone else, whether or not they are modified.
5.4 The Assets stay in the Account. The Assets may not be moved, copied, exported, cloned, snapshotted or rebuilt outside the Launch Marketing Suite agency account. This includes transferring them to another HighLevel account or agency, or recreating them on any other website builder, CRM or platform.
5.5 Printed materials. You may print and distribute the print designs (such as business cards, flyers and door hangers) to promote your own business while your subscription is active.
5.6 When the license ends. When your subscription ends, your license to the Assets ends and you must stop using them, except that you may use up printed materials you’ve already paid to produce.
6. Your content & data
6.1 What you own. You own your business name, logo, photos, written content and other materials you add (“Your Content”), and your customer and contact data (“Your Data”).
6.2 Our permission to use it. You give us permission to host, store, display and process Your Content and Your Data only as needed to provide the Service.
6.3 Your rights to it. You confirm you have the rights to everything you upload, including photos and testimonials, and that Your Data was collected lawfully with any consent required.
6.4 Exporting your data. You can export your contact list at any time while your subscription is active. After cancellation, you can request an export within 30 days, after which we may delete it. This does not include the Assets, which stay in the Account under section 5.
6.5 Domains. If you connect a domain you own, it remains yours. You can point it elsewhere at any time.
6.6 Privacy. Our handling of personal information is described in our Privacy Policy.
7. Email, text & phone compliance
7.1 You are solely responsible for the messages you send and the calls you make through the Service, and for following all applicable laws. These include the CAN-SPAM Act, the Telephone Consumer Protection Act (TCPA), state telemarketing and texting laws, and privacy laws.
7.2 You must obtain any consent the law requires before sending marketing texts or emails, honor opt-out requests promptly, and include required identification and opt-out information.
7.3 To send text messages in the U.S., you may need to complete carrier registration (A2P 10DLC) with accurate business information. Texting may be limited until registration is approved. Registration fees, if any, are your responsibility.
7.4 You must follow the Federal Trade Commission’s rules on reviews and testimonials. You may not post fake reviews, buy reviews, or offer incentives that require a positive review.
7.5 If you run ads, you must follow the advertising platform’s policies. Ad spend is paid by you directly to the platform and is not included in your subscription.
8. Acceptable use
You may not use the Service to:
- Break any law or anyone else’s rights, including intellectual property and privacy rights.
- Send spam, or contact people without required consent.
- Promote anything illegal, deceptive, hateful, sexually explicit or harmful.
- Upload malware, try to access other accounts, or interfere with the platform.
- Copy, reverse engineer or resell the Service or the Assets.
We may remove content or suspend your Account if we reasonably believe you’ve broken this section.
9. Third-party platforms
9.1 The Service is built on HighLevel and connects with other third-party services, such as phone and email providers, payment processors, social media platforms, Google and ad networks. Your use of those services may also be subject to their terms.
9.2 We don’t control third-party services and aren’t responsible for their outages, changes, policies or decisions, such as an ad account being suspended or a message being blocked by a carrier.
10. Onboarding & support
10.1 Your subscription includes a one-to-one onboarding session to help you get set up.
10.2 Support is available 24/7 through live chat, email and our help center. Response times may vary. Support covers help using the Service. Custom work, such as writing content, custom design or running campaigns for you, is not included in support but may be available for an additional fee.
11. No guarantee of results
We provide tools, templates and guidance, but your results depend on many things outside our control, including your market, offer, pricing, effort and how you use the Service. We don’t guarantee any particular number of leads, customers, reviews, search rankings, revenue or other results. The local marketing audit provides recommendations only.
12. Suspension & termination
12.1 We may suspend or end your Account if you don’t pay, break these Terms, or use the Service in a way that could harm us, the platform, other clients or the public. Where reasonable, we’ll give you notice and a chance to fix the problem first.
12.2 If your Account is ended for breaking these Terms, you are not entitled to a refund.
12.3 Sections that by their nature should survive termination, including sections 5, 6.4, 13, 14 and 16, will survive.
13. Disclaimers & limitation of liability
The Service is provided “as is” and “as available.” To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that the Service will be uninterrupted or error-free.
To the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or business opportunities. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the 3 months before the claim arose.
14. Indemnification
You agree to defend, indemnify and hold harmless us and our owners, employees and contractors from any claims, losses, fines and expenses (including reasonable attorneys’ fees) arising from Your Content, your messages and calls, your business, your breach of these Terms, or your violation of any law or third-party right.
15. Changes to these Terms
We may update these Terms from time to time. We’ll notify you of material changes by email or in your Account at least 30 days before they take effect. If you keep using the Service after changes take effect, you accept them. If you don’t agree, you may cancel before they take effect.
16. Governing law & disputes
These Terms shall be construed under the laws of British Columbia, Canada, without regard to its principles of conflicts of law. The courts of British Columbia, Canada shall be the exclusive jurisdiction and venue for all legal proceedings that are not arbitrated under these Terms. The parties hereby waive all rights to seek venue in other locations.
17. General
These Terms, together with our Privacy Policy and the details on our sales or checkout page, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest remains in effect. Our failure to enforce any part is not a waiver. You may not assign these Terms without our written consent; we may assign them, for example as part of a sale of our business.
